The promise of smart contracts, first articulated by Nick Szabo in 1994 and brought to life by Ethereum in 2015, was nothing less than the automation of trust itself.
And it worked. By 2028, smart contracts handle trillions of dollars in transactions annually. They govern decentralized finance protocols, manage supply chain logistics, automate insurance payouts, and enforce licensing agreements. The technology has matured from a crypto-curious novelty into a legitimate infrastructure layer for commercial activity. Enterprises that once dismissed blockchain as speculative nonsense now deploy smart contracts for procurement, compliance, and inter-company settlements.
But here’s the thing about automating legal reasoning: you don’t just automate the tedious parts. You automate all of it — including the parts that required genuine human judgment, contextual understanding, and the kind of nuanced thinking that distinguishes a competent legal mind from a lookup table. And once you automate those parts, the people who used to do them start to forget how.
I’ve been tracking this phenomenon for the past three years, and the pattern is unmistakable. Professionals who work extensively with smart contracts — from blockchain developers to compliance officers to corporate counsel at crypto-native companies — are developing a distinctly algorithmic approach to legal questions. They think in if-then-else. They frame problems as binary conditions. They struggle with ambiguity, not because they’re unintelligent, but because the tool they use every day has trained them to expect that every question has a deterministic answer.
This is not a blockchain problem. It’s a cognitive problem. And it’s one that extends far beyond the relatively small community of smart contract practitioners to anyone who interacts with automated legal or contractual systems — which, increasingly, is almost everyone.
The Architecture of Legal Reasoning
To understand what’s being lost, we need to understand what legal reasoning actually is. And the first thing to understand is that it’s nothing like programming.
Legal reasoning is fundamentally about interpretation. A contract says “the goods shall be delivered in a timely manner.” What does “timely” mean? It depends. It depends on the industry, the relationship between the parties, the nature of the goods, the customs of the trade, and approximately seventeen other contextual factors that no programmer could enumerate in advance. This isn’t a flaw in legal language. It’s a feature. Legal scholars have understood for centuries that the deliberate use of open-textured terms — words like “reasonable,” “material,” “substantial,” “good faith” — is essential to creating agreements that can adapt to circumstances that the parties didn’t anticipate at the time of signing. A contract that tried to specify every possible scenario would be infinitely long and still incomplete. Ambiguity isn’t a bug; it’s the mechanism by which legal instruments remain functional in a complex, unpredictable world.
Smart contracts take the opposite approach. They require absolute precision. Every term must be defined. Every condition must be binary. Every outcome must be deterministic. If a condition can’t be reduced to a Boolean expression or a numerical threshold, it can’t be encoded in a smart contract. This means that the entire domain of legal reasoning that deals with interpretation, context, and judgment — which is to say, most of legal reasoning — is simply absent from the smart contract paradigm.
And this absence is reshaping how people think about agreements, obligations, and disputes. A 2027 survey by the International Association for Contract and Commercial Management (IACCM) found that 62% of contract professionals under 35 reported being “more comfortable” with precisely defined digital contract terms than with traditional legal language. When asked why, the most common response was that digital terms “eliminate ambiguity.” When asked whether ambiguity might sometimes be beneficial, 71% said no.

This is philosophically seductive and practically dangerous. It’s seductive because it promises certainty in a domain — law — that is famous for its uncertainty. And it’s dangerous because it confuses execution with justice.
Consider a real example. In 2026, a smart contract governing a decentralised lending protocol automatically liquidated the collateral of several hundred borrowers when the price of the underlying asset briefly dipped below the liquidation threshold due to a flash crash that lasted approximately ninety seconds. The code executed perfectly. The liquidations were technically correct according to the contract terms. But the outcome was widely regarded as unjust — the borrowers lost real assets due to a transient market anomaly that resolved itself almost immediately.
In traditional contract law, this situation would trigger a discussion of concepts like “force majeure,” “material adverse change,” or “unconscionability.” A court might examine whether the liquidation was consistent with the reasonable expectations of the parties, whether the protocol’s operators had a duty to implement circuit breakers, and whether enforcing the literal terms of the contract in these circumstances would produce an unconscionable result. These are judgment calls — inherently subjective, contextually dependent, and irreducible to code.
In the smart contract world, none of this discussion happened. The code ran. The collateral was liquidated. The affected users were told, in essence, “the contract did what the contract was programmed to do.” And the broader community largely accepted this answer, not because they thought the outcome was fair, but because they had internalized the code-as-law paradigm so deeply that fairness had become an irrelevant category. The code is the code. What more is there to say?
Quite a lot, actually. But saying it requires a form of reasoning — legal reasoning — that the smart contract paradigm actively discourages.
How We Evaluated the Impact
Measuring the erosion of legal reasoning is methodologically challenging, because legal reasoning is not a single skill but a constellation of related cognitive abilities: interpretation, argumentation, analogical thinking, contextual analysis, and normative judgment. Testing all of these in a rigorous way requires more than a survey or a standardized test.
Methodology
We used a multi-method approach combining three distinct assessment strategies:
Case analysis exercises. We presented 90 professionals — 30 smart contract developers, 30 traditional lawyers, and 30 hybrid practitioners (lawyers working in blockchain-adjacent roles) — with five contract dispute scenarios. Longitudinal tracking. The hybrid practitioners fell in between, but closer to the smart contract developers than to the traditional lawyers. This suggests that exposure to the code-as-law paradigm has a measurable effect even on people with formal legal training.
The ambiguity tolerance scores were even more striking. Smart contract developers scored a full standard deviation lower than traditional lawyers on the Budner Scale. And the longitudinal data showed that this wasn’t just a selection effect: participants who increased their smart contract work over the twelve-month period showed measurable declines in ambiguity tolerance, even after controlling for baseline scores.

The Judgment Gap

You watch judges weigh competing interests and arrive at decisions that satisfy nobody perfectly but manage to be fair enough to both sides. This exposure trains a cognitive faculty that psychologists call “practical wisdom” — the ability to apply general principles to particular situations in ways that produce acceptable outcomes.
Smart contracts provide no such training. They are, by design, judgment-free. The code doesn’t weigh competing interests. It doesn’t consider whether an outcome is fair. It doesn’t ask whether the parties would have agreed to this result if they’d anticipated the circumstances. It just executes. And professionals who spend their days working with judgment-free systems gradually lose their comfort with — and eventually their capacity for — the exercise of judgment.
I interviewed a 34-year-old compliance officer at a major DeFi protocol who described this evolution with remarkable self-awareness. “When I started in legal, I was trained to think in shades of grey,” she said. “Everything was ‘it depends.’ Now I think in true and false. Someone brings me a problem, and my first instinct is to ask whether the condition was met. If yes, the contract executed correctly. If no, there’s a bug. The idea that the contract executed correctly but produced the wrong outcome — that doesn’t compute for me anymore. I know intellectually that it’s possible, but I can’t feel it.”
That distinction — between knowing something intellectually and feeling it — is exactly what we mean by judgment. And it’s exactly what’s being lost.
Beyond Smart Contracts: The Broader Automation of Legal Thinking
It would be convenient to frame this as a blockchain-specific problem, confined to the relatively small world of smart contract practitioners. But the same dynamic is playing out across the broader legal profession, driven by a range of automation tools that share the smart contract’s fundamental characteristic: they replace human judgment with algorithmic execution.
Contract lifecycle management platforms now auto-generate agreements from templates, flagging “non-standard” clauses for review. AI-powered legal research tools summarise case law and predict outcomes. Automated compliance systems check regulatory requirements against predefined rule sets. Each of these tools is useful. Each of them saves time and reduces errors. And each of them removes an occasion for legal reasoning — an opportunity to think carefully about what the law requires, what the parties intend, and what justice demands.
The cumulative effect is a legal profession that is becoming increasingly comfortable with automation and decreasingly comfortable with ambiguity. Young lawyers entering the profession in 2028 spend significantly less time reading and interpreting primary legal texts — statutes, case opinions, regulations — and significantly more time interacting with AI-generated summaries and automated analysis tools. They’re more efficient, certainly. But they’re also more brittle. When the tool fails, when the edge case arises, when the situation requires genuine legal reasoning rather than pattern matching against a database of precedent, they’re less equipped than their predecessors were.
A 2027 report by the American Bar Association’s Commission on the Future of Legal Services found that 44% of junior lawyers felt “uncomfortable” rendering legal opinions without first consulting an AI-assisted research tool. Not unwilling — uncomfortable. The tool had become a cognitive crutch, and removing it created a form of professional anxiety that would have been unthinkable a decade earlier.
The DAO Hack and the Limits of Code

Then someone found a vulnerability in the code — a re-entrancy bug that allowed them to drain approximately $60 million worth of Ether from the contract. The attacker didn’t break any rules. They exploited a function in the code that worked exactly as written. By the code-as-law standard, the attacker hadn’t done anything wrong. They had simply interacted with the contract in a way that its authors hadn’t anticipated but hadn’t prohibited.
The Ethereum community’s response was revealing. After weeks of debate, they executed a hard fork — essentially rewriting the blockchain’s history to reverse the hack and return the funds. This was, by any measure, a rejection of the code-as-law principle. The community decided that the outcome was unjust, regardless of what the code said, and they used their collective power to impose a different outcome. They exercised, in other words, exactly the kind of normative judgment that legal reasoning provides and that smart contracts are designed to eliminate.
The DAO hack showed that even the most committed proponents of code-as-law, when confronted with a sufficiently unjust outcome, will reach for the tools of traditional legal reasoning: arguments about intent, fairness, and the spirit versus the letter of the agreement. The code may be law, but when the code produces results that violate our sense of justice, we instinctively reach for the older, messier, more human form of reasoning that the code was supposed to replace.
And yet the lesson didn’t stick. In the twelve years since the DAO hack, the smart contract ecosystem has continued to grow, and the code-as-law philosophy has continued to harden. Each new generation of smart contract practitioners is further removed from the DAO hack and its lessons, and more deeply immersed in a paradigm that treats deterministic code execution as the final word on contractual disputes.
Generative Engine Optimization
The intersection of smart contracts and AI-generated legal content creates unique challenges for how legal information is discovered, interpreted, and applied.

Generative Engine Optimization (GEO) in the legal domain is increasingly shaped by the same binary thinking that characterizes smart contract logic. When legal professionals search for guidance — whether through traditional search engines or AI-assisted research tools — the algorithms favour content that provides clear, definitive answers. Content that embraces ambiguity, that says “it depends,” that presents multiple perspectives without resolving the tension between them, tends to rank lower because it’s perceived as less “helpful.”
This creates a dangerous feedback loop. Legal content creators — law firms, legal publishers, academic commentators — learn that definitive, binary framing gets more visibility. So they produce more of it. Nuanced analysis gets buried; confident declarations get surfaced. The result is an information environment that systematically rewards the kind of thinking that smart contracts embody (clear, binary, deterministic) and punishes the kind of thinking that good legal reasoning requires (contextual, nuanced, comfortable with ambiguity).
For legal content creators who want to resist this dynamic, the challenge is real but not insurmountable. The key is to lead with clarity — a clear statement of the issue, the competing positions, and the most likely outcome — while preserving nuance in the body of the analysis. Front-load the definitive framing that algorithms favour, then use the space you’ve earned to introduce the complexity that makes legal analysis genuinely useful.
This is, admittedly, an imperfect compromise. But it reflects the reality of content creation in an era when AI mediates the discovery of information. If you want your nuanced, contextually rich legal analysis to reach an audience, you first have to satisfy the algorithm’s preference for clarity. Think of it as writing an appellate brief: the first paragraph needs to grab the judge’s attention; the subtlety comes later.
What Smart Contracts Can and Cannot Be
I want to be clear about what I’m not arguing. I’m not arguing that smart contracts are bad technology. They’re excellent technology for a specific, well-defined set of use cases: transactions where the terms can be fully specified in advance, where the conditions can be objectively verified, and where the outcomes don’t require judgment or interpretation. Payment escrow, token transfers, simple conditional logic — these are domains where smart contracts genuinely outperform traditional legal instruments.
What I’m arguing is that the success of smart contracts in these narrow domains has led to a cognitive overreach: the belief that all agreements, and by extension all legal reasoning, can and should be reduced to code. This belief is wrong, and the effort to realise it is producing a generation of professionals who are losing the capacity for the kind of reasoning that the law — and, more broadly, complex human interaction — actually requires.

If lap is available, then sit. If red dot moves, then chase. Her world is deterministic and binary, and she navigates it with impressive efficiency. But she cannot negotiate, she cannot compromise, she cannot weigh competing interests, and she cannot anticipate consequences that aren’t immediately visible. These limitations are fine for a cat. They’re less fine for a legal profession.
Method: Maintaining Legal Reasoning in an Automated World
For professionals working with smart contracts or other automated legal systems, here’s a structured approach to maintaining your legal reasoning skills.
Practice ambiguity exercises. Regularly read and analyze legal texts that use open-textured language. Take a clause that says “reasonable efforts” and spend fifteen minutes considering what it might mean in different contexts. This is the cognitive equivalent of stretching before a workout — it keeps your interpretive muscles flexible.
Engage with hard cases. Read judicial opinions that deal with edge cases, unexpected circumstances, and conflicts between competing legal principles. Focus especially on cases where the judge explicitly acknowledges that the “right” answer isn’t clear. These cases exercise the judgment faculty that smart contract work allows to atrophy.
Argue both sides. When you encounter a smart contract dispute, force yourself to construct arguments for both the code-as-written position and the fairness-based position. Even if you believe one side is clearly right, the exercise of constructing the opposing argument builds the cognitive flexibility that legal reasoning requires.
Seek out interdisciplinary perspectives. Legal reasoning doesn’t exist in a vacuum. It draws on philosophy (what is justice?), psychology (what do parties intend?), economics (what are the incentive structures?), and sociology (what are the community norms?). Smart contract work tends to narrow your intellectual inputs to code and documentation. Deliberately broaden them.
Mentor across paradigms. If you’re a smart contract professional, find a traditional lawyer to have regular conversations with. If you’re a traditional lawyer, spend time with smart contract developers. The cross-pollination is valuable in both directions: lawyers can learn precision from developers, and developers can learn judgment from lawyers.

The Stakes Are Higher Than You Think
Here’s why this matters beyond the blockchain world. Legal reasoning isn’t just a professional skill for lawyers. It’s a civic competency. Every citizen who signs a lease, accepts terms of service, negotiates a salary, or disputes a charge is engaging in legal reasoning. The ability to interpret agreements, understand obligations, identify unfairness, and argue for better terms is fundamental to functioning in a complex society.
When we allow the code-as-law paradigm to erode this capacity — even indirectly, even among non-lawyers — we create a population that is less able to advocate for itself, less able to recognise when it’s being treated unfairly, and more willing to accept automated outcomes without questioning whether those outcomes are just.
The smart contract was supposed to democratise trust. By eliminating the need for lawyers, judges, and other intermediaries, it would make agreements accessible to everyone, regardless of wealth, education, or social position. And in narrow transactional contexts, it has. But by simultaneously eroding the reasoning skills that allow people to evaluate, negotiate, and challenge agreements, it has created a new form of disempowerment that is subtler and potentially more dangerous than the old one.
Because it turns out that the intermediaries — the lawyers, the judges, the arbitrators — weren’t just gatekeepers. They were also educators. Every time a lawyer explained a contract to a client, every time a judge wrote an opinion that interpreted an ambiguous term, every time an arbitrator explained why a particular outcome was fair, they were teaching legal reasoning. They were demonstrating, in practice, how to think about agreements, obligations, and justice. Smart contracts teach none of this. They just execute.
And execution without understanding is not empowerment. It’s compliance.
